What is an Industrial Design

An industrial design is the ornamental or aesthetic aspect of an article. The design may consist of three-dimensional features, such as the shape or surface of an article, or of two dimensional features, such as patterns, lines or colours.
Industrial designs are applied to a wide variety of products of industry and handicrafts. That is from technical and medical instruments to watches, jewellery and other luxury items, house wares and electrical appliances to vehicles and architectural structures and from textile designs to leisure goods.
An industrial design is primarily of an aesthetic or visual nature, and does not relate to the technical features of an article.

Advantages of Registered Designs

The owner of a registered design is able to prevent unauthorized copying or imitation of his or her design by third parties. In addition, as industrial designs add to the commercial value of a product and facilitate its marketing and commercialization, their protection helps ensure that a fair return on investment is obtained.
Protection of industrial designs encourages fair competition and honest trade practices. It leads to the production of more aesthetically attractive and diversified products, thereby broadening consumer choice.
Industrial design protection acts as a spur to a country’s economic development by contributing to the expansion of commercial activities and by enhancing the export potential of national product.

Disadvantages of Unregistered Designs

The owner of an unregistered design is unable to prevent unauthorized use of the design by third parties.
Protection of industrial designs encourages fair competition and honest trade practices.

Designs – Filing Requirements

  • Full name, address, profession / business and nationality of the applicant(s) and author(s) or designer(s).
  • Form-31, power of attorney, simply signed by the applicant(s) and author(s) or designer(s).
  • Four identical representations of the design. The representations may be photographs or specimens of the design/industrial model.
  • The photographs should be of each view of size 4 X 6.

Duration

The duration of registration of design/industrial model is initially 10 years from its date and may be extended by two further periods, each of ten years.

Priority

Priority date of the basic application filed in any of the WO member countries can be claimed in Pakistan within six months from the date of the earliest application for the registration of design in any of the convention countries (members of WTO).
